Home Health Care Aides

The home health care aide minimum wage applies to home health aides, personal care aides, home attendants, or other licensed or unlicensed persons whose responsibilities include the provision of in-home assistance with daily activities or healthcare-related tasks.  The home health care aide minimum wage does not apply to those working on a casual basis or relatives of the employer or person for whom the worker is delivering services.

Home health care aides who perform Medicaid-reimbursed work within New York City and the counties of Nassau, Suffolk and Westchester should also receive both the minimum wage and a supplemental benefit for every hour of work to satisfy the total compensation required under New York’s Wage Parity Act.

The required benefit portion for home health care aides is currently $2.54 per hour in New York City (down from $4.09 per hour in prior years) and $1.67 per hour in Nassau, Suffolk and Westchester counties (down from $3.22 per hour in prior years).  

The total compensation owed under the Wage Parity Act to home health care aides performing Medicaid-reimbursed work is $21.09 per hour in New York City and $20.22 per hour in Nassau, Suffolk and Westchester counties. The total compensation owed can be satisfied entirely through a payment of wages or through a combination of both wages and supplemental benefits.
