The outcome of the 2016 presidential election could significantly impact the new overtime rule under the Fair Labor Standards Act.

The rule is set to take effect on December 1, 2016, and extends overtime protections to millions of workers by increasing the salary threshold for full-time salaried employees who are exempt from overtime to $913 per week or $47,476 annually for a full-year worker.  The rule also raises the exemption level for highly compensated employees to $134,004 in total annual compensation.

Democratic presidential candidate Hillary Clinton unequivocally supports the rule, while Republican presidential candidate Donald Trump has been quoted as saying he favors a small-business exemption from the rule.  Read more about how the outcome of the presidential race will affect the rule here.
