Experienced Unpaid Overtime Lawyers
Your time is valuable — from a personal and financial perspective. When your employer is taking advantage of you by not paying you for the hours you have worked, you need skilled legal representation to help you get your money. At Virginia & Ambinder, LLP, we have been serving underpaid employees for two decades. We are dedicated to fighting for your rights to fair pay.
Our attorneys have represented thousands of workers in wage and hour cases, and we have served as class counsel in over 50 class action cases involving workers in all major industries.
Our firm handles cases involving:
- Automatic wage deductions for lunch periods and breaks
- Unlawful wage withholding for donning and doffing of equipment before and after the work shift
- Failure to pay for time spent working "off the clock"
- Misclassification of salaried workers to avoid paying overtime
- Incorrect classification of employees as independent contractors
Your employer is required to follow federal and state wage and hour laws regarding proper wages. We are committed to holding companies accountable for unpaid overtime.

What Am I Entitled To?
With very few exceptions, employees who work in excess of 40 hours in a week are subject to protection of the Fair Labor Standards Act (FLSA) and must be paid at a rate that is one and one-half times their regular hourly rate. For most workers, this applies to all time worked over 40 hours in a work week.
It is not up to your employer to decide if you are entitled to overtime pay. Even if you are salaried, you may be entitled to overtime pay, even if you have been told by your employer that you are exempt or that you are a "manager." We can help you determine your eligibility.
Employers often illegally classify their employees as independent contractors. Your employer may have incorrectly classified you as an independent contractor to avoid paying overtime, workers' compensation, social security and other benefits customarily provided to other workers such as pension and health benefits.
