FMLA and Americans With Disabilities Claims

Has your employer discriminated against you because you have cancer or another serious illness? Have you been fired or driven to quit to prevent you from taking short- or long-term disability leave? We can help you file a claim with the Equal Employment Opportunity Commission and pursue a lawsuit in federal court when appropriate.

Under the federal Family Medical Leave Act (FMLA), eligible employees are entitled to take up to 12 weeks of job-protected, unpaid leave during any 12-month period to care for a spouse, child, or parent who has a serious health condition, or to take care of the employee's own serious health condition. It also requires that eligible employees' health insurance benefits are maintained during the leave.

If you have a disability, you have several federal and state laws against workplace discrimination on your side. The Americans with Disabilities Act (ADA), the New Jersey Law Against Discrimination, and the New York Human Rights Law all mandate that employers establish "reasonable accommodations" for workers with disabilities.
