Are You Really an Independent Contractor?

Your employer may be illegally classifying you as an independent contractor to avoid paying you overtime and benefits, such as social security, worker's compensation and unemployment compensation. There are very strict rules set by the courts and the Department of Labor for classifying an employee as an independent contractor. At Virginia & Ambinder, LLP, we will help you protect your rights.

For two decades, our law firm has been defending the rights of underpaid and mistreated workers. With extensive experience in labor and employment law, our attorneys have represented thousands of workers in a variety of industries.

We are committed to holding companies accountable for violations of wage and hour laws. We can help you determine if you are being incorrectly and illegally classified as an independent contractor. Contact us for a free initial consultation.

Employer Penalties

Employers often illegally classify workers as independent contractors instead of as hourly or salaried employees to avoid paying medical and pension benefits or prevailing wages. And unlike employees, independent contractors do not have to be given meal periods and breaks.

If your employer has been incorrectly classifying you with a 1099 form as an independent contractor, you may be eligible to receive back wages and unpaid overtime. Your employer also might be liable for paying all of your withholding taxes and your Social Security payments as well.

The laws and the government are on your side, and so are we. You can rely on us for a thorough investigation of your case and aggressive representation.
